1. Who We Are
These Terms of Service ("Terms") govern your use of www.khaleejiland.com (the "Site") and your purchase of products from KhaleejiLand FZC ("KhaleejiLand", "we", "us", "our"), a company registered in Ajman Free Zone, United Arab Emirates (License No. 42212), with its registered address at B.C. 1302630, Ajman Free Zone C1 Building, Ajman Free Zone, Ajman.
"You" means the person using the Site or placing an order. "Products" means the items we sell on the Site.
By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms are available in English and Arabic. If there is any conflict between the two versions, the English version applies.
Your personal information is handled in accordance with our Privacy Policy, which forms part of these Terms.
2. Who Can Use This Site
You must be at least 18 years old to place an order. Our products are designed for children, but must be purchased and used under adult supervision.
3. Business and Bulk Orders
Orders placed through the standard Site checkout are governed by these Terms, regardless of whether the buyer is an individual or an organization. If you are a school, nursery, or other organization looking to place a bulk or wholesale order outside the standard checkout, please contact us at info@khaleejiland.com. Separate bulk or wholesale terms apply only where we have agreed them with you in writing.
4. Placing an Order
When you place an order, you are making an offer to buy the Products, which we may accept or decline. The order confirmation email you receive after checkout is a receipt confirming we have received your order, not our acceptance of it. We accept your order, and our contract with you is formed, when we dispatch it.
You agree that the information you provide when placing an order, including your contact and billing details, is accurate and complete.
Once an order has been placed, we may not be able to cancel or amend it because our fulfilment partner begins processing orders automatically. If you need to request a change, please contact us immediately, and we will try to help where possible.
5. Our Products
We try to show product colors, sizes, packaging, and details as accurately as possible. Minor differences may still occur, due to your screen settings, product photography, production batches, or updates to packaging. These differences do not necessarily mean a product is faulty.
We may discontinue a product at any time and may limit the quantity of any product available to a customer.
6. Our Right to Cancel an Order
We may cancel or decline an order at any point before dispatch, including where:
- a Product is out of stock or unavailable,
- there has been a pricing or listing error,
- we suspect fraud or an unauthorized transaction, or
- we are otherwise unable to fulfil the order.
If we cancel an order after payment has been taken, we will refund you in full.
7. Prices
All prices on the Site are shown in UAE Dirhams (AED) and include 5% VAT. We currently sell in AED only.
We may change prices at any time without notice. This does not affect an order you have already placed and that we have confirmed as dispatched.
8. Payment
We accept the payment methods shown at checkout. Payment is due at the time you place your order.
Payment security is handled by our third-party payment provider(s). We do not store your full card details.
You confirm that any payment method you use belongs to you or that you are authorized to use it.
If a payment is declined or fails, your order will not be processed.
9. Promotions and Discount Codes
Discount codes and promotional offers cannot be exchanged for cash. Codes may be subject to an expiry date or other conditions, which will be stated when the code is issued. Unless we state otherwise, only one discount code may be used per order. We may correct any obvious error in a promotion or discount code, including where a discount was issued or applied incorrectly.
If a specific promotion has its own terms and they conflict with these Terms, the promotion's terms apply to that promotion.
10. Delivery
We currently deliver within the UAE only. Delivery fees, timeframes, and related terms are set out in our Shipping Policy, which forms part of these Terms.
You are responsible for providing a complete and accurate delivery address and a reachable phone number. We are not responsible for a failed delivery caused by an incorrect or incomplete address or phone number.
Risk of loss or damage in transit stays with us until you receive your order. This does not apply where loss, delay, or misdelivery results from an incorrect or incomplete address or phone number you provided.
11. Returns and Refunds
Returns, exchanges, and refunds are governed by our Returns Policy, which forms part of these Terms.
12. Product Safety
Our products are age-graded and carry safety information, including choking hazard warnings where relevant. This information is provided on each product page. Please read it before use.
13. Your Account
If you create an account, you are responsible for keeping your login details secure and for all activity on your account. Tell us immediately if you suspect unauthorized use of your account.
14. Prohibited Use
You must not misuse the Site. This includes attempting to commit fraud, scraping or copying our content, uploading malicious code, interfering with checkout or other site functions, providing false information, or using the Site for any unlawful purpose.
If you use an automated tool or AI agent to access or use the Site, it must not misrepresent itself as a human user or attempt to bypass any security or bot-detection measures we use.
15. Indemnification
To the extent permitted by law, you agree to compensate us for reasonable losses we suffer because of your fraud, misuse of the Site, or submission of content that infringes someone else's rights.
16. Termination
We may suspend or terminate your account or your access to the Site at any time if we reasonably believe you have breached these Terms, including the Prohibited Use section above.
17. Free Resources and Worksheets
Free downloadable worksheets and activities on the Site are for personal use in your home or in a single classroom. You may not resell or redistribute them, upload them to public websites, WhatsApp groups, marketplaces, file-sharing platforms, or school portals accessible beyond your own class, or remove KhaleejiLand branding from them.
18. Reviews and Other Content You Submit
If you submit a review or other content on the Site, you give us permission to display it and to use it in our marketing, including on social media. This may include your first name, your review text, your rating, and any photo or video you submit, along with your general location if you have provided it. We may edit your content for length or format, without changing its meaning.
If a photo or video you submit includes an identifiable child, uploading it means you confirm that you are that child's parent or legal guardian, that you are authorized to share it, and that you agree to our use of it as described above.
You may ask us to remove any content you have submitted, including images or videos, by contacting us. We will take reasonable steps to remove it from channels we control, but removal may not be possible where content has already been printed, shared by others, cached, or used in materials already produced.
You must not submit anything false, offensive, or that infringes someone else's rights. We may remove any content at our discretion.
19. Marketing Communications
If you sign up to receive emails, SMS, or WhatsApp messages from us, this is governed by our Privacy Policy.
20. Third-Party Links and Services
The Site uses third-party services, including payment providers, analytics tools, review platforms, and email marketing tools, and may link to third-party websites such as Instagram. These are governed by their own terms and privacy policies. We are not responsible for the content or practices of any third-party website or service.
21. Relationship with Shopify
In this section, "Services" means the Site and the products and services we make available through it.
KhaleejiLand is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with KhaleejiLand. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and KhaleejiLand, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with KhaleejiLand.
22. Site Content Disclaimer
Information on the Site, including blog posts and other educational content, is provided for general informational purposes only. We try to keep it accurate and up to date, but it should not be relied on as professional, medical, or educational advice specific to your child.
23. Our Liability
We are not liable to you for any indirect or consequential loss, including loss of income, data, or opportunity, arising from your use of the Site or purchase of Products.
Nothing in these Terms limits your rights under UAE Consumer Protection Law.
24. Intellectual Property
All content on the Site, including text, images, illustrations, and designs, belongs to KhaleejiLand or our licensors. You may not copy, reproduce, or use it without our written permission.
25. Severability
If any part of these Terms is found to be invalid or unenforceable, the rest of these Terms will remain in full effect.
26. Waiver and Entire Agreement
If we do not enforce a right or provision in these Terms, this does not mean we have waived that right or provision. These Terms, together with the policies referenced in them, are the entire agreement between you and us about the Site, and replace any earlier agreements or understandings between us.
27. Assignment
You may not transfer your rights or obligations under these Terms without our written consent. We may transfer or assign these Terms at any time without notice to you.
28. Headings
The headings in these Terms are for convenience only and do not affect their meaning.
29. Changes to These Terms
We may update these Terms at any time. Changes take effect as soon as we publish them on the Site. Your continued use of the Site after a change means you accept the updated Terms.
30. Governing Law and Disputes
These Terms are governed by the laws of the United Arab Emirates. Any dispute is subject to the exclusive jurisdiction of the courts of Ajman.
